End User Agreement

Acceptance of Agreement

By creating an account or using the COACHD App, LLC / COACH’D, you agree to this End User Agreement (“Agreement”), along with the Terms & Conditions, Privacy Policy, and all other COACH’D policies. If you do not agree, you must discontinue use of the platform

Description of the Service

COACH’D is a digital platform that enables athletes and coaches to connect, communicate, schedule sessions, and share training content. COACH’D does not employ coaches, guarantee results, or supervise training activities.

Eligibility

To use COACH’D, you must:
• Be at least 13 years old (or the minimum age in your region)
• Have parental consent if under 18
• Be legally able to enter this Agreement
COACH’D may restrict or terminate access for users who do not meet eligibility requirements.

Account Responsibilities

You agree to:
• Provide accurate registration information
• Maintain the confidentiality of your login credentials
• Be responsible for all activity under your account
• Notify COACH’D of any unauthorized access
COACH’D may suspend accounts for suspicious or harmful activity.

User Conduct

You must follow the User Code of Conduct and agree not to:
• Harass, threaten, or abuse others
• Share explicit, illegal, or harmful content
• Impersonate another person
• Attempt to hack or disrupt the platform
• Circumvent payment systems
• Use COACH’D for unrelated commercial activity
Violations may result in immediate removal.

Interactions with Coaches and Athletes

COACH’D provides communication tools but does not:
• Verify all coach qualifications
• Supervise training sessions
• Guarantee safety during in-person meetings
• Resolve disputes between users
You are solely responsible for evaluating the suitability of coaches or athletes you interact with.

Payments & Transactions

Payments may be processed through third-party providers. By using payment features, you agree to:
• Pay all applicable fees
• Follow the provider’s terms
• Accept that COACH’D may charge service fees
Refunds follow the Refund Policy.

Content Ownership & License

You retain ownership of content you upload. However, you grant COACH’D a non-exclusive, worldwide license to:
• Store
• Display
• Transmit
• Use your content to operate the platform
You may not upload copyrighted material without permission.

Health & Safety Disclaimer

You acknowledge that:
• Training and exercise involve inherent risks
• COACH’D does not provide medical advice
• Coaches are independent contractors
• You should consult a medical professional before beginning any training program
COACH’D is not liable for injuries or damages resulting from training activities.

Liability Waiver

By using COACH’D, you agree to the full Liability Waiver and release COACH’D from claims related to:
• Injuries
• Accidents
• Training outcomes
• In-person interactions
• Equipment or facility use
You assume all risks associated with athletic activity.

Privacy & Data Use

Your use of COACH’D is subject to the Privacy Policy, which explains how data is collected, stored, and used. You agree not to misuse or share other users’ personal information.

Third-Party Services

COACH’D may integrate with third-party tools. COACH’D is not responsible for:
• Their performance
• Their policies
• Their security practices
Your use of third-party services is at your own risk.

Termination

COACH’D may suspend or terminate your account for:
• Violations of this Agreement
• Fraudulent or harmful behavior
• Repeated complaints
• Legal or safety concerns
You may delete your account at any time.

Limitation of Liability

To the fullest extent permitted by law, COACH’D is not liable for:
• Loss of data
• Service interruptions
• Damages from user interactions
• Training-related injuries
• Errors or omissions in content
Your sole remedy is to discontinue use of the platform.

Indemnification

You agree to indemnify and hold harmless COACH’D, its owners, and partners from claims arising from:
• Your use of the platform
• Your interactions with other users
• Your violation of this Agreement
This includes legal fees and damages.

Modifications to the Agreement

COACH’D may update this Agreement at any time. Continued use of the platform constitutes acceptance of the updated terms.

Governing Law

This Agreement is governed by the laws of the state of Alabama, unless otherwise required by your local jurisdiction.
